Lenders Appeal Court Decision Allowing HOAs to Extinguish Mortgages

This is something that has always baffled me, and despite all the back and forth of the Judicial court system, we still don’t have a clear answer on what HOAs can and cannot do when it comes to foreclosing for non payment of the monthly dues. In any case, when a homeowner stops paying the monthly dues the threat of foreclosure is real, therefore I ALWAYS recommend to keep paying the hoa dues, even when the property is listed as a short sale.
